การจัดตั้งองค์กรการจัดเก็บค่าลิขสิทธิ์ของภาคเอกชนและภาครัฐ ในประเทศไทยและต่างประเทศ

Abstract

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาการบริหารการจัดเก็บค่าลิขสิทธิ์ที่ดำเนินการจัดเก็บค่าลิขสิทธิ์ โดยองค์กรบริหารการจัดเก็บค่าลิขสิทธิ์ โดยได้ศึกษาความเป็นมาเกี่ยวกับการบริหารการจัดเก็บค่าลิขสิทธิ์ ประเภทขององค์กรจัดเก็บค่าลิขสิทธิ์ และวิธีการดำเนินการทำงานขององค์กรจัดเก็บค่าลิขสิทธิ์ รวมไปถึงกฎหมายที่ใช้บังคับในการจัดเก็บค่าลิขสิทธิ์ เพื่อวิเคราะห์ถึงแนวทางในการบริหารจัดเก็บค่าลิขสิทธิ์โดยองค์กรจัดเก็บค่าลิขสิทธิ์ให้เป็นไปในทางที่เหมาะสม อีกทั้งประโยชน์ในการจัดตั้งองค์กรจัดเก็บค่าลิขสิทธิ์ของประเทศไทยไปจนถึงการเสนอรูปแบบของกฎหมายหรือภาครัฐที่เข้ามาควบคุมกำกับดูแล เพื่อมิให้เกิดการผูกขาดของเอกชนไปในฝ่ายเดียว จากการศึกษาพบว่า การจัดตั้งองค์กรจัดเก็บค่าลิขสิทธิ์ของประเทศไทย มีปัญหาในการจัดตั้งอยู่ เนื่องจากไม่มีบทบัญญัติกฎหมายที่รองรับในการจัดตั้งองค์กรจัดเก็บค่าลิขสิทธิ์เป็นการเฉพาะ เมื่อศึกษาจากกฎหมายการจัดเก็บค่าลิขสิทธิ์ของประเทศ ญี่ปุ่น สหรัฐอเมริกา ออสเตรเลีย อังกฤษ นั้นพบว่า ประเทศญี่ปุ่นมีบทกฎหมายใกล้เคียงที่มาบังคับใช้ซึ่งกำกับดูแลการดำเนินงานขององค์กรจัดเก็บค่าลิขสิทธิ์ ในประเทศอังกฤษองค์กรจัดเก็บค่าลิขสิทธิ์จัดตั้งขึ้นโดยอาศัยบทบัญญัติที่นิยาม คำว่า “องค์กร” และใช้อำนาจกฎหมายทั่วไปที่เกี่ยวข้องกับการบริหารการจัดเก็บค่าลิขสิทธิ์ในการควบคุมดำเนินงานขององค์กรจัดเก็บค่าลิขสิทธิ์ ต่อมาประเทศออสเตรเลียและสหรัฐอเมริกา แม้ประเทศออสเตรเลียและสหรัฐอเมริกา จะมิได้มีบทบัญญัติกฎหมายเป็นการเฉพาะเหมือนประเทศญี่ปุ่น หรือบทนิยามที่บัญญัติคำว่าองค์กรไว้เช่นเดียวกับประเทศอังกฤษ แต่อย่างไรก็ตามก็มีภาครัฐที่เข้ามามีบทบาทกำกับดูแลในการจัดเก็บค่าลิขสิทธิ์ จากประเด็นปัญหาในข้างต้น ผู้วิจัยมีความคิดเห็นและข้อเสนอแนะว่า ควรจัดตั้งองค์กรจัดเก็บค่าลิขสิทธิ์ในรูปแบบที่เหมาะสมให้สอดคล้องกับวัฒนธรรม เศรษฐกิจ สังคมในปัจจุบัน และมีการตรากฎหมายเฉพาะเพื่อใช้บังคับในการจัดเก็บค่าลิขสิทธิ์ ซึ่งประกอบไปด้วย โครงสร้างสำคัญในการตรากฎหมายขึ้นมาใหม่ หรือบัญญัตินิยามคำว่า องค์กรจัดเก็บ เป็นการเฉพาะเพื่อ กำกับดูแลและกำหนดบทลงโทษ

The objective of the study was to investigate the management of royalty collection by royalty collection management organizations. This study was a research the history of royalty collection management, types of royalty collection organization and methods of operation, governing law to analyze the guidelines for manage the appropriate royalty collection. Including the benefits of establishing a royalty collection organization in Thailand and proposing a form of law or government to control in order to avoid monopoly from the private company. Base on the findings, it was concluded that the establishment of an organization for royalty collection in Thailand still has problems. There is no law that supports the establishment of the organization to royalty collection values specifically. The research was found that Japan has specific copyright laws. In England, Royalty Collection Organizations are established based on the provisions that specifically define the word “organization”. Australian laws are not the same as Japan and England. However, there are government agencies that control the collection of royalties. The issues mentioned above the researcher was recommended that the royalty collection organization should be established in accordance with the current culture, economy, and society. And there should be a specific law to be enforced in the collection of royalties, which consists of important structure in the re-enactment of the law or the definition of specific copyright collection organizations to determine the punishment.
