มาตรการการให้ความคุ้มครองพันธุ์สัตว์ภายใต้กฎหมายสิทธิบัตรของประเทศไทย

Abstract

งานวิจัยในครั้งนี้มีจุดมุ่งหมายเพื่อศึกษาระบบกฎหมายสิทธิบัตรที่เอื้อต่อการคุ้มครองพันธุ์สัตว์ ซึ่งจะช่วยส่งเสริมให้เกิดการวิจัยและพัฒนาสายพันธุ์สัตว์ในประเทศไทยมากยิ่งขึ้น โดยได้ศึกษาจากการคุ้มครองพันธุ์สัตว์ในประเทศสหรัฐอเมริกา และกลุ่มประเทศสหภาพยุโรป ซึ่งเป็นกลุ่มประเทศที่เป็นผู้นำด้านการให้ความคุ้มครองพันธุ์สัตว์และมีระบบกฎหมายที่คุ้มครองพันธุ์สัตว์อย่างมากประเทศหนึ่ง นอกจากนี้ยังได้ศึกษาการคุ้มครองพันธุ์สัตว์โดยระบบกฎหมายสิทธิบัตรในประเทศไทย เพื่อให้ทราบว่าควรจะคุ้มครองพันธุ์สัตว์ให้มีความเหมาะสมและมีประสิทธิภาพสูงสุดอย่างไร จากการศึกษาพบว่าการใช้ระบบสิทธิบัตรคุ้มครองพันธุ์สัตว์มีปัญหาหลายประการทั้งเชิงกฎหมาย ศีลธรรม สังคม และค่านิยม เนื่องจากการพัฒนาสายพันธุ์สัตว์เป็นเทคโนโลยีใหม่ที่มีผลต่อการพัฒนาและสร้างสิ่งมีชีวิตใหม่ขึ้นมาซึ่งมีคุณสมบัติแตกต่างไปจากเดิม ดังนั้นบรรทัดฐานของกฎหมายสิทธิบัตรจึงไม่สามารถคุ้มครองพันธุ์สัตว์ได้อย่างเหมาะสม งานวิจัยฉบับนี้ ผู้เขียนได้เสนอแนะให้ใช้กฎหมายสิทธิบัตรคุ้มครองแก่พันธุ์สัตว์ โดยการปรับบรรทัดฐานของกฎหมายสิทธิบัตรให้มีขอบเขตความคุ้มครองที่ชัดเจน และเพิ่มมาตรการพิเศษบางประการเพื่อให้กฎหมายสิทธิบัตรสามารคุ้มครองพันธุ์สัตว์ได้อย่างเหมาะสมและมีประสิทธิภาพเป็นประโยชน์ต่อประเทศให้มากที่สุด

This research focuses on patent protection of animals varieties – the aim is to identify legal factors which encourage and development of animals varieties in Thailand. The methodology includes comparative study of protection of animals varieties provide by the US. Patent law, the European Patent Convention and patent laws of other states. Finally, the author thoroughly analyses Thailand patent law and other related factors which may have an impact on research and development of animals varieties in Thailand with a view to identify factors necessary to protect animals varieties and at the same time encourage research and development in the field while maintaining international norms and standard. Due to rapid technology advancement, the protection regime for animals varieties in any given society is combination of various factors including legal, economic, social, political and moral ones. Apparently, present patent criteria lacks efficient mechanism to protect animals varieties and to serve different goals each society may have given the complexity of interactions and level of animals varieties development at any point of time.
