ข้อพิพาทของการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse): ศึกษาคดีและกฎหมาย

Abstract

การศึกษาเรื่อง ข้อพิพาทของการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse): ศึกษาคดีและกฎหมายที่เกี่ยวข้องกับการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน มีวัตถุประสงค์เพื่อศึกษาแนวคิดเกี่ยวกับชุมชนโลกเสมือน (Metaverse) ภายใต้กฎหมายเครื่องหมายการค้าและข้อพิพาทของการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) อีกทั้งเพื่อศึกษากฎหมายที่เกี่ยวข้องกับการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) และเพื่อศึกษาแนวทางและข้อเสนอแนะในการปรับใช้กฎหมายเครื่องหมายการค้าสำหรับการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) ของประเทศไทยให้เกิดประสิทธิภาพเพิ่มมากขึ้น รวมถึงวิเคราะห์และสร้างข้อเสนอแนะปรับปรุงกฎหมายเครื่องหมายการค้าสำหรับการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) ผลการศึกษามีดังนี้ กลุ่มประเทศที่มีข้อพิพาทของการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) ได้แก่ ประเทศสหรัฐอเมริกา, สหภาพยุโรป ได้กำหนดแนวทางในการพิจารณาข้อพิพาทของการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) โดยให้ความสำคัญต่อการที่มีบุคคลอื่นนำเครื่องหมายการค้าของผู้เป็นเจ้าของเครื่องหมายการค้าที่แท้จริงไปใช้ในชุมชนโลกเสมือน (Metaverse) อันทำให้ผู้เป็นเจ้าของเครื่องหมายการค้าดังกล่าว เกิดความเสียหาย เสียชื่อเสียง รวมถึงทำให้สาธารณชนมีความเข้าใจที่ผิดในแหล่งกำเนิดของสินค้า (False Designation of Origin) และกลุ่มประเทศที่ยังไม่มีข้อพิพาทของการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) ได้แก่ สาธารณรัฐอินเดีย, สหพันธ์สาธารณรัฐบราซิล, สาธารณรัฐประชาชนจีน ประเด็นปัญหาหลักสำหรับกลุ่มที่ยังไม่มีข้อพิพาทของการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) เป็นเรื่องเขตอำนาจศาล เป็นเรื่องที่สำคัญที่จะต้องมีการกำหนดเขตอำนาจศาลให้ชัดเจน ระหว่างเขตอำนาจศาลในชุมชนโลกเสมือน (Metaverse) กับโลกความจริง สำหรับกรณีมีการพิจารณาคดีและข้อพิพาทเกี่ยวกับการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) ผลการศึกษายังแสดงให้เห็นอีกว่าหากประเทศไทยเกิดประเด็นและข้อพิพาทการจดทะเบียนเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) ศาลไทยควรมีแนวทางในการพิจารณาคดีไปในแนวทางใด และควรมีการพิจารณาในเรื่องของขอบเขตการใช้เครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) และประเด็นการละเมิดเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) อย่างไร เนื่องจากปัญหาเกิดจากการที่มีบุคคลนำเครื่องหมายการค้าในโลกแห่งความจริงของบุคคลอื่นมาใช้ในชุมชนโลกเสมือน (Metaverse) โดยไม่ได้รับอนุญาตบนเว็บไซต์ หรือบนแพลตฟอร์มอื่น อันทำให้ผู้เป็นเจ้าของเครื่องหมายการค้าเกิดความเสียหายโดยผู้เป็นเจ้าของเครื่องหมายการค้าที่แท้จริงต้องพิสูจน์ให้ศาลเห็นถึงความเสียหายที่เกิดจากการละเมิดเครื่องหมายการค้าในชุมชนโลกเสมือน (Metaverse) และเสนอให้กรมทรัพย์สินทางปัญญาเพิ่มจำพวกสินค้า และบริการในชุมชนโลกเสมือน (Metaverse) จากจำพวกที่ 9 จำพวกที่ 35 ให้สามารถจดทะเบียนเครื่องหมายการค้าได้มากขึ้น เพื่อรองรับการขายสินค้าและบริการในชุมชนโลกเสมือน (Metaverse) และเทคโนโลยีที่จะพัฒนาขึ้นในอนาคตต่อไป

The study of disputes regarding trademark registration in the virtual world community (Metaverse). Study cases and laws related to trademark registration in the virtual world community. The objective is to study the concept of the virtual world community (Metaverse) under trademark law and disputes regarding trademark registration in the virtual world community (Metaverse). Moreover, the objectives are also to study the law related to trademark registration in the virtual world community (Metaverse) and to study guidelines and suggestions for applying trademark law to registration of trademarks in Thailand's Metaverse community to be more efficient. The study also analyzes and creates suggestions for improvement of trademark registration in Metaverse. The research finds that countries with trademark registration disputes in the virtual world (Metaverse) include USA and EU that have governed guidelines for trademark registration disputes considerating. The guidelines focus on people who illegally use trademarks that belong to rightful owner in real world as their own trademark in the virtual world community (Metaverse) which cause rightful owner to be damaged, dishonoured along with being misled the public about the origin of products. In addition, countries without trademark registration disputes in the virtual world (Metaverse) include the Republic of India, The Federative Republic of Brazil, The People's Republic of China. Main point for non disputing groups in trademark registration is a jurisdictional issue. It is important to clearly define jurisdiction between the virtual world (Metaverse) and the real world. Research also finds that if Thailand has trademark registration issues and disputes in the virtual world (Metaverse), how guidelines should suggest Thai court about consideration and scope of trademark using in the virtual world (Metaverse), and trademark infringement issues in Metaverse which caused by people who illegally use real world trademarks in the virtual world community (Metaverse) without permission from owners of trademark. Trademark infringement causes rightful owner to be damaged which must prove to the court about the damages. The Intellectual Property Court should increase products and services in trademark registration categories 9 and 35 so it would be able to register more trademarks for supporting products and services in virtual world communities and technologies to be developed in the future.
