ความคาบเกี่ยวการคุ้มครองระหว่างสิ่งบ่งชี้ทางภูมิศาสตร์กับภูมิปัญญาท้องถิ่น: กรณีศึกษาเครื่องปั้นดินเผาด่านเกวียน

Abstract

การคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ในประเทศไทยนั้น กำหนดให้ความคุ้มครองแก่สินค้าที่มีชื่อเสียง คุณภาพ หรือลักษณะเฉพาะใด ๆ ที่ทำให้สินค้าดังกล่าวมีความพิเศษแตกต่างจากสินค้าชนิดเดียวกันในแหล่งกำเนิดอื่น ๆ ซึ่งชื่อเสียง คุณภาพ หรือลักษณะเฉพาะเช่นว่านี้ เป็นผลมาจากปัจจัยทางภูมิศาสตร์ของแหล่งกำเนิดสินค้าประกอบภูมิปัญญาท้องถิ่นในการผลิตสินค้าของผู้คนในชุมชนแหล่งกำเนิดโดยปัจจัยทั้งสองนี้ถือว่ามีสำคัญไม่น้อยไปกว่ากัน สินค้าที่มีคุณสมบัติหรือลักษณะเช่นว่านี้มีอยู่มากมายในประเทศไทย ทั้งที่ได้ขึ้นทะเบียนเป็นสิ่งบ่งชี้ทางภูมิศาสตร์ตามกฎหมาย และที่ยังไม่ได้รับความคุ้มครองใด ๆ ตามกฎหมายเช่นเครื่องปั้นดินเผาด่านเกวียนซึ่งเป็นสินค้าที่เกิดจาก ภูมิปัญญาท้องถิ่นด้านหัตกรรมของหมู่บ้านด่านเวียนและมีความเชื่อมโยงกับปัจจัยทางภูมิศาสตร์ ด้วยคุณสมบัติหรือลักษณะของเครื่องปั้นดินเผาด่านเกวียน เมื่อนำมาพิจารณาตามพระราชบัญญัติคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ พ.ศ. 2546 ร่างพระราชบัญญัติส่งเสริมและคุ้มครอง ภูมิปัญญา พ.ศ. ...... และพระราชบัญญัติส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรม พ.ศ. 2559 พบว่าสามารถขอรับความคุ้มครองจากกฎหมายทั้งสามข้างต้นได้ จึงก่อให้เกิดความคาบเกี่ยวการคุ้มครองตามกฎหมายทั้งสาม แต่ด้วยปัจจุบันร่างพระราชบัญญัติส่งเสริมและคุ้มครองภูมิปัญญา พ.ศ. ...... ยังไม่สถานะเป็นกฎหมาย และประเทศไทยก็ยังไม่มีกฎหมายที่สามารถให้ความคุ้มครองแก่ภูมิปัญญาท้องถิ่นได้อย่างครอบคลุม จึงทำให้กระบวนการผลิตเครื่องปั้นดินเผาที่เป็นภูมิปัญญาท้องถิ่นของหมู่บ้านด่านเกวียนอาจถูกนำไปใช้ประโยชน์โดยไม่ชอบ โดยเฉพาะอย่างยิ่งการนำไปใช้ประโยชน์ในทางการค้าโดยไม่มีการแบ่งปันประโยชน์ใด ๆ สู่หมู่บ้านด่านเกวียน ดังนั้นถึงเวลาแล้วที่ประเทศไทยควรจะดำเนินการออกกฎหมายที่สามารถให้ความคุ้มครองแก่ภูมิปัญญาท้องถิ่นได้อย่างครอบคลุม เพื่อคุ้มครองและรักษาภูมิปัญญาท้องถิ่นไว้ให้ทรงคุณค่า รวมถึงรักษาผลประโยชน์ต่าง ๆ ของชุมชนผู้ถือครองภูมิปัญญาท้องถิ่น

Protection of geographical indications in Thailand requires protection to its renowned quality or characteristics of any kind that makes the product special and different from other products. The reputation, quality, or characteristic is the result of the geographical factors of origin, the local wisdom in the production of goods of people in the origin community. These two factors are considered to be of the same importance. There are so many products with the qualities or characteristics in Thailand that are both registered as legal geographical indications and there is still no legal protections such as Dan Kwian pottery, which is a product of local wisdom, the art of Dan Kwian village, and linked to geographic factors. When the qualities or characteristics of Dan Kwian pottery are taken into consideration based on the Geographical Indications Protection Act, BE 2546 (2003), Protection and Promotion of Wisdom Draft Act, BE ...., and Preservation and Protection of Intangible Cultural Heritage Act BE 2559 (2016), it was found that it is able to obtain the protection of the law from all three laws, the legal protection overlaps thus occurs. However, the Protection and Promotion of Wisdom Draft Act, BE ....has not yet become law. Additionally, Thailand has no law that can provide comprehensive coverage of local wisdom. Thus, the production process of local wisdom pottery of Dan Kwian village may be exploited particularly commercial exploitation without sharing any benefits to Dan Kwian village. Therefore, it is time for Thailand to implement legislation that can provide comprehensive coverage of local wisdom to protect and preserve local wisdom and the interests of the local wisdom community.
