Abstract: การให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์นั้นมีวิวัฒนาการในการให้ความคุ้มครองมาอย่างช้านานผ่านความตกลงระหว่างประเทศหลายฉบับ อาทิ ความตกลงกรุงปารีส ความตกลงกรุงมาดริด ความตกลงกรุงลิสบอน ความตกลงทริปส์ ซึ่งประเทศไทยในฐานะประเทศภาคีสมาชิกองค์การการค้าโลกมีหน้าที่ที่จะต้องอนุวัติการกฎหมายภายในให้มีความสอดคล้องกับพันธกรณีภายใต้ความตกลงทริปส์ จึงได้ตราพระราชบัญญัติคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ พ.ศ. 2546 เพื่อให้การคุ้มครองสิ่งบ่งชื้ทางภูมิศาสตร์ภายในประเทศมีมาตรฐานสอดคล้องกับมาตรฐานขั้นต่ำที่ความตกลงทริปส์กำหนดไว้ แต่อย่างไรดี นับตั้งแต่ที่ได้มีการประกาศใช้พระราชบัญญัติคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ พ.ศ. 2546 จนถึงปัจจุบัน พระราชบัญญัติดังกล่าวยังมิเคยได้รับการทบทวนเพื่อปรับปรุงแก้ไขแต่อย่างใด ประกอบกับได้มีการตราพระราชกฤษฎีกาการทบทวนความเหมาะสมของกฎหมาย พ.ศ. 2558 เพื่อทบทวนความเหมาะสมของกฎหมายให้มีความสอดคล้องและเหมาะสมกับสถานการณ์ในปัจจุบัน ผู้ศึกษาจึงได้ทำการศึกษาถึงปัญหาความสอดคล้องกับมาตรการในการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ภายใต้มาตรฐานสากล โดยเฉพาะอย่างยิ่ง ระเบียบประชาคมยุโรปเลขที่ 1151/2012 และความตกลงหุ้นส่วนทางเศรษฐกิจภาคพื้นแปซิฟิค (TPP) เพื่อเป็นแนวทางในการปรับปรุงพระราชบัญญัติคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ พ.ศ. 2546 นั่นเอง จากการศึกษาวิเคราะห์เปรียบเทียบมาตรการในการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ภายใต้พระราชบัญญัติคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ พ.ศ. 2546 เปรียบเทียบกับระเบียบประชาคมยุโรปเลขที่ 1151/2012 พบว่า มาตรการในการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ตามกฎหมายไทยหลายประการไม่สอดคล้องกับระเบียบประชาคมยุโรปดังกล่าว อาทิ ประเภทของสิ่งบ่งชี้ทางภูมิศาสตร์ที่ได้รับความคุ้มครอง การกำหนดตัวบุคคลผู้มีสิทธิยื่นคำขอ ระยะเวลาการตรวจสอบคำขอขึ้นทะเบียน ระดับของการคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ ระบบการควบคุมตรวจสอบคุณภาพสินค้าและการตรวจสอบย้อนกลับ ตลอดจนการตรวจสอบคุณสมบัติของสินค้าก่อนวางตลาด ซึ่งจากการศึกษาระเบียบประชาคมยุโรปเลขที่ 1151/2012 มีรายละเอียดที่ชัดเจน มีความเหมาะสมกับสถานการณ์ในปัจจุบัน และเป็นตลาดสำคัญสำหรับการส่งออกสินค้าสิ่งบ่งชี้ทางภูมิศาสตร์ของไทย ในทางตรงกันข้าม เนื่องจากมาตรการในการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ภายใต้ความตกลงหุ้นส่วนทางเศรษฐกิจภาคพื้นแปซิฟิค (TPP) เป็นเพียงการกำหนดมาตรฐานที่ประเทศภาคีสมาชิกจะต้องปฏิบัติตาม จึงมิได้มีรายละเอียดที่ชัดเจน ซึ่งหากมีการโต้แย้งในประเด็นที่ไม่ชัดเจนเหล่านั้น อาจเกิดเป็นข้อพิพาทที่จะต้องมีการตีความมาตรการดังกล่าว อีกทั้ง มาตรการในการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ภายใต้ความตกลงดังกล่าวค่อนข้างให้ความสำคัญกับการคุ้มครองเครื่องหมายการค้ามากกว่าการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ นอกจากนี้ ความเกี่ยวพันกันระหว่างมาตรการในการให้ความคุ้มครองเครื่องหมายการค้าภายใต้ความตกลงดังกล่าวอาจส่งผลกระทบต่อการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์อีกด้วย จากปัญหาดังกล่าวเหล่านี้ ผู้ศึกษามีความเห็นว่า การปรับปรุงมาตรการทางกฎหมายในการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ของไทยให้มีความสอดคล้องกับระเบียบประชาคมยุโรปเลขที่ 1151/2012 ย่อมเป็นผลดีต่อการคุ้มครองสินค้าสิ่งบ่งชี้ทางภูมิศาสตร์ไทยมากกว่าการปรับปรุงกฎหมายตามที่ความตกลงหุ้นส่วนทางเศรษฐกิจภาคพื้นแปซิฟิค (TPP) ได้กำหนดไว้นั่นเอง
The protection of Geographical Identifications (GI) has long been developed under international agreements such as the Paris Agreement, the Madrid Agreement, the Lisbon Agreement and the Agreement on Trade – Related Aspects of Intellectual Property Rights (TRIPS Agreement). Since Thailand, as a member of World Trade Organization (WTO), has duty to amend its own laws and regulations in order to comply rules with and regulations prescribed by TRIPS Agreements, the Protection of Geographical Identification Act B.E.2546 has been, therefore, enacted for the purpose of the enforcement of minimum standards specified by said Agreement. Since an enactment of the Act on Protection of Geographical Identification B.E.2546, the revision of such Act has not been made. In addition, an enactment of the Act, namely the Royal Decree on the revision of Acts for an appropriateness of law B.E. 2558 has a rationale for the revision of all Acts for proper enforcement under present circumstance. this research, consequently, focuses on problems relating to the consistency of the protection measures for Geographical Identification of such Act and International Standard’s, especially in the area of the Regulation (EU) NO.1151/2012 and the Trans Pacific Partnership Agreement (TPP). In this case, the means to improve the said Thai Act shall, thus, occur. It appears from the study that the measures to protect Geographical Identifications under the Protection of Geographical Identification Act B.E.2546, in comparison to the Regulation (EU) NO. 1151/2012, are inconsistent with such EU regulation in many aspects, such as a Geographic Indication that eligible for protection, person eligible to apply for registration, the examination of the application, the protection degree for the Geographical Identifications, product quality control system, traceability and quality check prior to launching product period. It also appears that the Regulation (EU) NO. 1151/2012 has clearly details and suitable for present circumstances. In addition, it is an important market to export Thailand’s Geographical Identification products. In contrast, since the measures for the protection of Geographical Identification under the Trans Pacific Partnership Agreement (TPP) is merely the specification of standards which the Parties shall comply. It is, therefore lack of crystal clear in details and an interpretation of such measures may incur in the form of disputes. Moreover, the measure for the protection of the Geographical Identification under TPP tends to promote Trademark protection rather than the Geographical Identification protection. In addition, the connection between the measures for Trademark protection under TPP may affect the Geographical Identification protection as well. From the problems mentioned above, it can be concluded that the revision on the legal measures for the protection of Geological Identification of Thailand in accordance with the Regulation (EU) NO. 1151/2012 is more benefits to Thailand than revision of law according to the Agreement specified by TPP.
