Abstract: | ปัญหาในการให้ความคุ้มครองการออกแบบผลิตภัณฑ์ที่มีหน้าที่การใช้งานโดยอาศัยพระราชบัญญัติสิทธิบัตร พ.ศ. 2522 ก่อให้เกิดปัญหาในการบังคับใช้กฎหมายที่ยังคงไม่มีความชัดเจนในหลายๆ เรื่อง โดยเฉพาะอย่างยิ่ง ปัญหาเกี่ยวกับแบบผลิตภัณฑ์ที่มีหน้าที่การใช้งาน
(functional) ในเรื่องที่กฎหมายไม่ได้บัญญัติไว้อย่างชัดเจนว่าควรให้ความคุ้มครองแบบผลิตภัณฑ์ที่มีคุณลักษณะทางหน้าที่การใช้งานภายใต้สิทธิบัตรการออกแบบผลิตภัณฑ์หรือไม่
เมื่อเกิดกรณีพิพาทขึ้น ศาลไทยในบางคดีได้รับรองแนวคิดของการปฏิเสธแบบผลิตภัณฑ์ที่มีหน้าที่ในการทำงาน โดยตีความการออกแบบผลิตภัณฑ์ว่าต้องทำให้แบบผลิตภัณฑ์มีลักษณะพิเศษ แต่ไม่ได้ระบุไว้ว่าลักษณะพิเศษของการออกแบบต้องเป็นข้อกำหนดในการจดสิทธิบัตร จึงทำให้เป็นปัญหาว่าการออกแบบผลิตภัณฑ์ที่ดีที่ควรต้อง คำนึงถึงประโยชน์ใช้สอยของแบบผลิตภัณฑ์ประกอบด้วยเสมอ ถูกกฎหมายการออกแบบผลิตภัณฑ์ของหลายๆ ประเทศจำกัดมิให้คุ้มครองแบบผลิตภัณฑ์ที่เป็นไปเพื่อประโยชน์ใช้สอยโดยแท้เท่านั้น (คำนึงถึงประโยชน์ใช้สอยมากกว่าการออกแบบเพียงเพื่อความสวยงามแต่เพียงภายนอก) หากแบบผลิตภัณฑ์ใดได้ถูกออกแบบมาเพื่อความสวยงามอันอาจดึงดูดใจสาธารณชน แต่ขณะเดียวกันก็มีลักษณะของประโยชน์ใช้สอยประกอบอยู่ด้วยก็ต้องใช้ดุลพินิจในการพิจารณาเป็นรายกรณีว่าจะได้ความคุ้มครองอย่างสิทธิบัตรการออกแบบผลิตภัณฑ์หรือไม่
ดังนั้น สารนิพนธ์เล่มนี้จะศึกษาให้เห็นถึงแนวความคิดทางกฎหมายของการให้ความคุ้มครองการออกแบบผลิตภัณฑ์ที่สามารถใช้งานได้ โดยเปรียบเทียบการคุ้มครองการออกแบบผลิตภัณฑ์ที่สามารถใช้งานได้ของประเทศไทยกับกฎหมายของประเทศสหรัฐอเมริกา ประเทศสหราชอาณาจักร และ Agreement on Trade Related Aspects of Intellectual Property
Rights (TRIPs) ในเรื่องเดียวกันเพื่อที่จะนำเสนอแนวทางแก้ปัญหาการคุ้มครองสิทธิบัตรการออกแบบผลิตภัณฑ์ในแบบผลิตภัณฑ์ที่สามารถใช้งานได้ ซึ่งหากมีการแก้ไขเพิ่มเติมในประเด็นการ
คุ้มครองสิทธิของแบบผลิตภัณฑ์ที่สามารถใช้งานได้อย่างเป็นรูปธรรมแล้วผู้เขียนเชื่อว่าจะช่วยให้มีการคุ้มครองการออกแบบผลิตภัณฑ์ที่สามารถใช้งานได้อย่างชัดเจนมากยิ่งขึ้นรวมไปถึงส่งเสริมให้
มีการพัฒนาแบบผลิตภัณฑ์มากขึ้นด้วย The problem of issuing a design patent for functional product design under
the Patent Act B.E. 2522 is still unclear as to whether a product design that is able to
function partly or wholly as a product utility should be able to register as a design patent or
not. Thai patent law does not state clearly about the related provisions. In addition,
Thai courts have tried to endorse the repudiation of functional product design by giving an
interpretation of “Special Appearance” in Section 3 of the Patent Act despite there is no
certain definition of the word. As a result, most functional designs were refused to be
registered as the design patent by the courts.
Since a good product design should aid the functions of the product and be
useful, the refusal to register a functional product design as a design patent by the patent
office and the court should not be allowed. Unfortunately, Patent Laws in many countries
does not give protection to a design that is wholly functional. (A design that is more useful
than being attractive by its visual appearance.) A product that is designed for purely visual
appearance to attract people is more welcome. However, the problem is still going on with
a design that is able to function for a product as well as having an attractive visual
appearance as to whether it should be registered as a design patent or not. This must be a
duty of the court to use its discretion on a case by case basis.
This individual study will focus on the provision of a design patent for a
functional product design in Thailand compared to those of the U.S., U.K., and Agreement
on Trade Related Aspects of Intellectual Property Rights (TRIPs). The author believes that
this research can more or less provide solutions to the problems of protection of functional
product design in Thailand and may expedite the amendment of the Patent Act on this
issue. As such, Thailand’s product designs may also be protected and improved to its best. |
