Abstract: งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษา แนวทางการคุ้มครองสิทธินักแสดงภายใต้สนธิสัญญาปักกิ่งว่าด้วยการแสดงในโสตทัศนวัสดุขององค์การทรัพย์สินทางปัญญาโลก โดยศึกษาสิทธิข้างเคียง (Neighboring Rights) ของนักแสดงตามพระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 การคุ้มครองสิทธิข้าง เคียงตามกฎหมายระหว่างประเทศ ได้แก่ Rome Convention 1961, WIPO Copyright Treaty (WCT) 1996, WIPO Performances and Phonograms Treaty (WPPT) 1996 และ Beijing Treaty on Audiovisual Performances 2012 รวมทั้งกฎหมายของประเทศสหรัฐอเมริกา จากการศึกษาพบว่า การคุ้มครองสิทธินักแสดงในประเทศไทยนั้นมีขึ้นภายหลังจากการประกาศใช้ พระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 ซึ่งนำหลักเกณฑ์ของ Rome Convention 1961 มาเป็นแนวทางในการคุ้มครองสิทธินักแสดง และสนธิสัญญาฉบับดังกล่าวได้จัดทำขึ้นมาเป็นเวลานานประกอบกับเทคโนโลยีในการบันทึกภาพการแสดงหรืองานโสตทัศนวัสดุได้มีการพัฒนามากขึ้นทำให้การคุ้มครองสิทธินักแสดงตามพระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 ไม่เพียงพอต่อการคุ้มครองประโยชน์จากการบันทึกการแสดงในงานโสตทัศนวัสดุของนักแสดงในประเทศไทยอีกต่อไป และมีผลทำให้นักแสดงสูญเสียรายได้มหาศาล ซึ่งเมื่อศึกษาการคุ้มครองนักแสดงตามสนธิสัญญาระหว่างประเทศ ได้แก่ WIPO Copyright Treaty (WCT) 1996, WIPO Performances and Phonograms Treaty (WPPT) 1996 นั้นพบว่ามีการคุ้มครองเพียงสิ่งบันทึกเสียงการแสดงเท่านั้น ต่อมาในปี ค.ศ. 2012 ได้มีการตรา Beijing Treaty on Audiovisual Performances 2012 ขึ้นและมีหลายประเทศได้ให้สัตยาบันสนธิสัญญาฉบับนี้ อย่างไรก็ตาม ประเทศไทยยังมิได้ลงนามเป็นภาคีสมาชิก ซึ่งผู้วิจัยได้ทำการศึกษาสนธิสัญญาฉบับดังกล่าวเปรียบเทียบกับพระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 แล้วพบว่าสิทธิของนักแสดงตามมาตรา 44 และมาตรา 45 มีปัญหาต่อการคุ้มครองสิทธิของนักแสดงในปัจจุบัน ได้แก่ 1) ปัญหาการตีความของคำว่า “นักแสดง” 2) ปัญหาพระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 ไม่มีการคุ้มครองสิทธิทางศีลธรรมหรือ ธรรมสิทธิ์ (Moral Rights) ของนักแสดง ทำให้หากมีการกระทำใด ๆ แก่งานอันมีที่มาจากการแสดงอันทำให้เสียชื่อเสียงหรือเกียรติคุณของนักแสดง นักแสดงไม่สามารถดำเนินการใด ๆ ได้ตามกฎหมาย 3) ปัญหาความชัดเจนในการคุ้มครองสิทธิของนักแสดงกรณีการแสดงสด และการแสดงที่อยู่ในโสตทัศนวัสดุ 4) ปัญหามาตรา 45 แห่งพระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 ไม่คุ้มครองการได้รับค่าตอบแทนจาการนำต้นฉบับหรือสำเนางานโสตทัศวัสดุของนักแสดงไปใช้เพื่อวัตถุประสงค์ทางการค้า ในขณะที่ Beijing Treaty on Audiovisual Performances 2012 ได้ให้ความคุ้มครองสิทธินักแสดงในเรื่องของสิทธิทางศีลธรรมหรือธรรมสิทธิ์ (Moral Rights) และให้ความชัดเจนในเรื่องของการคุ้มครองการแสดงสด และการแสดงในงานโสตทัศนวัสดุ รวมทั้งให้ความคุ้มครองการได้รับค่าตอบแทนจาการนำต้นฉบับหรือสำเนางานโสตทัศวัสดุของนักแสดงไปใช้เพื่อวัตถุประสงค์ทางการค้า ดังนั้น ผู้วิจัยจึงมีข้อเสนอแนะว่า ประเทศไทยควรที่จะเข้าร่วมเป็นสมาชิกใน Beijing Treaty on Audiovisual Performances 2012 เพื่อให้สิทธินักแสดงได้รับการคุ้มครองที่ครอบคลุม โดยเฉพาะการคุ้มครองงานแสดงที่อยู่ในโสตทัศนวัสดุ ซึ่งพระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 และสนธิสัญญาฉบับอื่นไม่ได้ให้ความคุ้มครองเอาไว้นั่นเอง
The purpose of this research is to study the guideline for performers' rights protection under the World Intellectual Property Organization's Beijing Treaty on Audiovisual Performances, including neighboring rights of the performers under Thailand's Copyright Act B.E. 2537 (1994) as well as neighboring rights protection under international laws, i.e., Rome Convention 1961, WIPO Copyright Treaty (WCT) 1996, WIPO Performances and Phonograms Treaty (WPPT) 1996, Beijing Treaty on Audiovisual Performances 2012 and the U.S. Performers Right Protection Law. The finding of the study shows that the performers’ right protection in Thailand officially exists after the enacting of Copyright Act B.E. 2537, which the regulations of the Rome Convention 1961 had been adopted and applied to the aforesaid Act, which at that time, the recording and audiovisual technologies were not much developed as it is nowadays. At the present, the protection under the Copyright Act is insufficient to protect the benefits that performers in Thailand should gain from Audiovisual Performances recording and this gap causes loss of incomes. According to the international treaties, such as WIPO Copyright Treaty (WCT) 1996, WIPO Performances and Phonograms Treaty (WPPT) 1996, there was only the protection for sound recording. Later in 2012, after the existence of Beijing Treaty on Audiovisual Performances, which many states have ratified the treaty, the treaty shows that the scope of protection was expended but Thailand has not yet joined as member state. As a result,the researcher compares the differences between Copyright Act B.E. 2537 and Beijing Treaty on Audiovisual Performances 2012 and finds that section 44 and section 45 of the Act cause problems of interpretation as follows: 1) the interpretation problems due to the definition of "performer"; 2) the lack of contents related to performers' moral rights protection under Copyright Act B.E. 2537; consequently, the performers cannot take any legal actions in case their reputations and honors are abused; 3) problem in clear-cut interpretation of live performances and recorded performances protection; 4) section 45 of the Copyright Act B.E. 2537 does not cover the earning of remuneration in case the original work or copy used for commercial purposes by others. In contrast, Beijing Treaty on Audiovisual Performances 2012 provides protection to performers towards moral rights as well as provides clear-cut explanation on protection of live performances and recorded performances. The treaty also covers the remuneration from the original work or its copies being used for commercial purposes. Therefore, the researcher suggests that Thailand should be a part of Beijing Treaty on Audiovisual Performances 2012 as member state for expanding scope of performers rights protection as the Copyright Act B.E. 2537 and other treaties does not cover the necessary contents as mentioned above.
