แนวคิดและปัญหาความเป็นเจ้าของลิขสิทธิ์ในงานสร้างสรรค์ร่วมกัน : ศึกษากรณีวิกิพีเดีย

Abstract

สารนิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาถึงแนวคิดในเรื่องความเป็นเจ้าของลิขสิทธิ์ใน งานสร้างสรรค์ร่วมกันโดยนำการสร้างสรรค์งานร่วมกันของเว็บไซด์วิกิพีเดียมาเป็นกรณีศึกษา โดยได้ศึกษาบทบัญญัติตามกฎหมายไทยและต่างประเทศเกี่ยวกับงานสร้างสรรค์ร่วมกัน เพื่อที่จะนำมาใช้พิจารณาถึงแนวทางและหลักเกณฑ์ที่เหมาะสมในการกำหนดว่าบุคคลใด สมควรที่จะเป็นเจ้าของลิขสิทธิ์ในงานสร้างสรรค์ร่วมกันนั้น นอกจากนี้ยังรวมถึงการศึกษา เกี่ยวกับหลักเกณฑ์ในการให้ความคุ้มครองงานอันมีลิขสิทธิ์ที่ปรากฏบนเครือข่ายอินเทอร์เน็ต ด้วย ทั้งนี้ข้อมูลที่นำมาใช้ทำการศึกษานั้นมาจากบทความในอินเทอร์เน็ต ตำราวิชาการ ภาษาไทยและภาษาต่างประเทศ จากการศึกษาวิจัยพบว่าแนวคิดงานสร้างสรรค์ร่วมกันนี้ เริ่มได้รับความนิยมอย่างแพร่หลายภายใต้เครือข่ายอินเทอร์เน็ต การให้ความคุ้มครองแก่ งานสร้างสรรค์ร่วมกันบนที่ปรากฏบนเครือข่ายดังกล่าวก็ควรจะปรับให้เข้ากับพฤติกรรม ของผู้ใช้งานโดยคำนึงพิจารณาถึงรูปแบบความก้าวหน้าของเทคโนโลยีนั้นด้วย ซึ่งเงื่อนไข การคุ้มครองลิขสิทธิ์แก่งานสร้างสรรค์ร่วมกันนั้นได้ถูกกำหนดให้อยู่ภายใต้เงื่อนไขของ ข้อเท็จจริงที่ว่า ผู้สร้างสรรค์ร่วมเหล่านั้นได้รู้อยู่แล้วในขณะที่สร้างงานว่าเป็นงานที่ตั้งใจหรือ เจตนาร่วมงานกันที่จะให้ผลงานนั้นกลายเป็นงานเดียวเช่นนี้จึงจะถือว่าเป็นงานที่สามารถ คุ้มครองลิขสิทธิ์งานที่มีผู้สร้างสรรค์หลายคนได้

This research is intended to study the concept of the ownership of the collaborative work which brought the wikipedia website as a study case. It focuses on Thailand and foreign country act which concern with the co-copyright work. This document and information will be the idea and solution to what person should entitle the ownership right in collaborative work. Moreover we desire to study the protection of the copyright regulation which occurs on the internet. All document and information came from the article on internet, domestic and international textbook, after the research founded that The research demonstrated that the idea of the co-creator of the copyright work are popular at this moment and spread throughout the internet network. The protection for the joint authorship on the network must be adjusted to the personality of the user, which concern to the progression of the technology. The term of protection must be identified conform to the fact that co-creator must know that copyright work was created by both creator and concur that copyright work must be only one copyright work. If all this term were complied, the protection for the copyright work will be enforceable
