Abstract: ในปัจจุบันเป็นยุคที่มีการใช้เทคโนโลยีสารสนเทศอย่างแพร่หลาย โดยเฉพาะสื่อสังคมออนไลน์ซึ่งสื่อสังคมออนไลน์นี้เป็นที่มาของการรังแกทางไซเบอร์ (Cyber Bullying) อันเป็นรูปการกลั่นแกล้งโดยใช้สื่อสังคมออนไลน์กล่าวคือ การทะเลาะกันผ่านโทรศัพท์มือถือ ข้อความ หรือห้องสนทนา โดยใช้ภาษาที่รุนแรง หรือหยาบคาย (Flaming) การเผยแพร่ข้อมูลเท็จทำให้ผู้อื่นได้รับ ความเสียหาย อับอาย หรือกลายเป็นตัวตลก (Denigration) การลบ บล็อก หรือกีดกันผู้อื่นออก จากกลุ่ม โดยสร้างความเกลียดชัง อคติผ่านข้อความ หรือกิจกรรมกลุ่มออนไลน์ (Exclusion) การนำข้อมูลส่วนตัว หรือความลับของผู้อื่นไปเผยแพร่ (Outing) การแอบอ้างชื่อ หรือตัวตนของผู้อื่น (Impersonation) การสร้างบัญชีใช้งานปลอมเพื่อรังแกผู้อื่น (Fake Profiles) การขโมยอัตลักษณ์ออนไลน์ของผู้อื่นแล้วนำมาสร้างบัญชีการใช้งานเพื่อหลอกลวง หรือทำลายชื่อเสียง (Catfishing) การก่อกวน คุกคาม ข่มขู่ผู้อื่นซ้ำ ๆ หลายครั้ง (Harassment) เป็นต้นโดยเฉพาะอย่างยิ่งบนโซเชียลมีเดียที่ทุกอย่างเมื่อถูกแชร์ผ่านสื่อสังคมออนไลน์จะสามารถสร้างความเสียหายได้อย่างรวดเร็วและ ส่งผลเสียอย่างมากในปัจจุบัน สำหรับประเทศไทยมีเพียงกฎหมายอาญามาตรา 326 มาตรา 328 และมาตรา 393 ที่สามารถนำมาปรับใช้ลงโทษผู้กระทำความผิดหากแต่บทลงโทษนั้นไม่รุนแรงพอที่จะยับยั้งหรือปราบปรามผู้กระทำความผิด นอกจากนี้ยังมีพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2560 มาตรา 11 มาตรา 14 และมาตรา 16 แต่ก็ยังไม่ครอบคลุมถึงการกระทำความผิดในลักษณะของการรังแกผ่านสื่อสังคมออนไลน์ดังนั้นจึงมีความจำเป็นที่ต้องศึกษาพฤติกรรมลักษณะของการรังแกทางสื่อสังคมออนไลน์เพื่อหามาตรการทางกฎหมายที่เหมาะสมสำหรับประเทศไทยต่อไป จากการศึกษาพบว่า ประเทศไทยนั้นยังไม่มีกฎหมายที่ออกมาเพื่อแก้ไขปัญหาการรังแกทางสื่อสังคมออนไลน์ อาทิ เฟสบุ๊ค หรือทวิทเตอร์เป็นการเฉพาะ มีเพียงประมวลกฎหมายอาญา และพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2560 ซึ่งยังไม่สามารถเอาความผิดกับผู้กระทำผิดได้โดยตรง โดยข้อกฎหมายดังกล่าวยังมีข้อจำกัดในการดำเนินคดีตามความผิด เนื่องจากสื่อสังคมออนไลน์รวมถึงเครือข่ายอินเตอร์เน็ตมีรูปแบบที่ซับซ้อนและมีการพัฒนาอย่างสม่ำเสมอ ทำให้บทบัญญัติกฎหมายไทยยังไม่สามารถปรับให้ทันกับเทคโนโลยีที่เปลี่ยนไปอย่างรวดเร็วได้ ดังนั้น ในขณะที่ยังไม่มีกฎหมายเฉพาะเกี่ยวกับการกลั่นแกล้งทางสื่อสังคมออนไลน์นี้ การลงโทษผู้กระทำความผิดนั้นจะต้องพิจารณาถึงองค์ประกอบความผิดทั้งตามประมวลกฎหมายอาญา และพระราชบัญญัติว่าด้วยการกระทําความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 (แก้ไขเพิ่ม เติม พ.ศ. 2560) โดยลงโทษผู้กระทำความผิดตามกฎหมายทั้ง 2 ฉบับรวมกัน แต่เพื่อให้กฎหมาย มีความชัดเจนมากขึ้น ผู้วิจัยมีความคิดเห็นว่า ควรจะมีการแก้ไขบทลงโทษที่บัญญัติอยู่ในประมวลกฎหมายอาญามาตรา 393
Nowadays, it is recognized that it is the age of information technology. This makes people communicate with others easier via electronic media, which is called social media. Social media provides many advantages to people’s life such as making the world smaller; however, it can cause harm to users in some aspects. Among that is called ‘Cyber Bullying’. It can defame other people’s dignity or reputation by entering into social media, such as quarrelling on phone, message or chat room by using impolite language. Using fake data defames other’ reputation. This includes delete or block people from social group or group activity by making hatred or prejudice. To spread out personal data or personal secret and fake profile for swindling, it ruins and insults such people on social media where the information can share and cause such person damage. For Thailand, under Section 326, 328 and 393 of the Criminal Code can be applied to this problematic issue. However, the punishment under these is not severe enough to stop or excuse the offender. Further, Thailand recently amended a law on computer offenses and The Computer-related Crime Act (No. 2) B.E. 2560 (Sections 11, 14 and 16). Considering these two laws, they provide a higher penalty rate for defamation. Nonetheless, it does not cover the offense of cyber bullying in order to provide appropriate legal measures. The study finds that Thailand has specific rules or Sections for solving cyber bullying issue via social media such as Facebook or Twitter. Even Thailand has already promulgated Thai Criminal Code, Cyber Crime Act B.E. 260 and The Bill of Personal Data Protection Act B.E. …, there is a grab of law for this problematic issue. This means these laws cannot sufficiently apply to this offence. The problem is also complicated to prove because the nature of social media itself. Consequently, Thailand, at the moment, does not have the specific law for cyber bullying, it must be considered under the Criminal Code and Computer-related Crime Act (No.2) B.E. 2560. However, for a precise rule, this research suggests Thailand amend the Act in order to be applied to cyber bulling. In doing so, this research also suggests the law provide strong penalty, which in Criminal Code Section 393.
