การกระทำความผิดผ่านทางอินเตอร์เน็ต : ศึกษากรณีการเผยแพร่ภาพและสื่อลามกอนาจารโดยผ่านโปรแกรมแคมฟรอก (Camfrog)

Abstract

พัฒนาการทางเทคโนโลยีคอมพิวเตอร์และเครือข่ายอินเทอร์เน็ตซึ่งเป็นสื่อประเภทหนึ่งที่มีความสำคัญในระบบการสื่อสารโทรคมนาคมของโลกปัจจุบัน เป็นเครือข่ายการติดต่อสื่อสารไร้พรมแดน ก่อให้เกิดเสรีภาพในการเผยแพร่ข้อมูลข่าวสารต่างๆ อย่างไร้ขีดจำกัด จึงทำให้มีผู้อาศัยหรือใช้ประโยชน์จากเครือข่ายอินเทอร์เน็ตเป็นเครื่องมือหรือช่องทางในการกระทำความผิดทางคอมพิวเตอร์ในหลากหลายรูปแบบรวมถึงการเผยแพร่ภาพและสื่อลามกทางเครือข่ายอินเทอร์เน็ตด้วย สารานิพนธ์ฉบับนี้มีจุดหมายที่จะศึกษาเกี่ยวกับการกระทำความผิดทางคอมพิวเตอร์ โดยศึกษาเฉพาะกรณีการเผยแพร่ภาพและสื่อลามกอนาจารโดยผ่านโปรแกรมแคมฟรอก (Camfrog) เนื่องจากการกระทำดังกล่าวนั้นส่งผลกระทบต่อความสงบเรียบร้อยและศีลธรรมอันดีของสังคมโดยเฉพาะกับวัยรุ่นไทย ทำให้มาตรฐานทางศีลธรรมอันดีงามของสังคมไทยเสื่อมทรามลง อีกทั้งอาจก่อให้เกิดปัญหาอาชญากรรมทางเพศและปัญหาทางสังคมอื่นๆ ตามมา นับว่าปัญหาดังกล่าวเป็นปัญหาที่สำคัญเนื่องจากปัญหาการเผยแพร่สื่อลามก ได้พัฒนารูปแบบโดยใช้เครือข่ายอินเทอร์เน็ตที่ยากต่อการที่จะเข้าไปควบคุมกำกับดูแลและปราบปรามได้อย่างมีประสิทธิภาพ หากบทบัญญัติของกฎหมาย เจ้าหน้าที่ และหน่วยงานของรัฐที่เกี่ยวข้องยังไม่มีศักยภาพที่เพียงพอ จากการศึกษาพบว่า ประเทศต่างๆ ทั่วโลกต่างก็ประสบกับปัญหานี้เช่นเดียวกันและได้มีความพยายามที่จะใช้มาตรการทางกฎหมายที่ออกมาใช้บังคับเฉพาะกับการกระทำความผิดทางคอมพิวเตอร์ รวมถึงมาตรการทางสังคมต่างๆ ที่เข้ามาควบคุมดูแลการใช้อินเทอร์เน็ตในระดับที่แตกต่างกัน ด้วยเหตุผลทางด้านศีลธรรม วัฒนธรรม ขนบธรรมเนียมประเพณีและนโยบายในการให้สิทธิเสรีภาพแก่ประชาชนที่แตกต่างกัน สำหรับประเทศไทยในขณะนี้กำลังมีการพยายามร่างกฎหมายเกี่ยวกับการกระทำความผิดทางคอมพิวเตอร์ออกมาใช้บังคับกับปัญหาดังกล่าว และเพื่อให้กฎหมายมีประสิทธิภาพมากขึ้นจึงควรมีการพัฒนาปรับปรุงกฎหมายให้มีความทันสมัยเท่าทันกับกระการเปลี่ยนแปลงและพัฒนาของเทคโนโลยีทางคอมพิวเตอร์และอินเทอร์เน็ต นอกเหนือจากมาตรการทางกฎหมาย อาจต้องนำมาตรการทางเทคนิคและทางสังคมมาใช้ร่วมกันด้วย ทั้งนี้เพื่อที่รักษาไว้ซึ่งความสงบเรียบร้อย ศีลธรรมอันดีของประชาชน

The Computer Technology Development and The Internet Network are the one of significant communication system in the world. These global communication systems provided us the unlimited accession, broadcasting and distribution of the information. In Contrast, there were many people committed a crime, which include the distribution of the pornography and the obscene materials, on internet. This Independent Study will concentrate and study on the offence on the internet. Especially, on the pornography and the obscene materials which have been distributed on The Cam frog because this behavior is directly effect to our merit and moral society. The condition of our society will be shatter. The crime rate, which involves rape and sexual harassment, will enormously expand. The consequence will be suffered by the children and the teenagers. This explanation indicates that the offences on the internet are varietally transformed into many formations which are impractical for the government to dealing or controlling the situation. This was the result form the insufficient law and regulation which issued by the officer, the authority and the government. After analysis this problems, the author founded that many country in this world have been facing this problems and have put a lot of afford to draft and issue the regulation ,the social protocol or law which will be enforce and control the offence on the computer in every different level. There were a lot of efforts to draft the law by Thailand Government to deal with these problems and improve the capability of the law. We have to modernize the law to keep up with the modification of computer, technology and internet. And if we combined the technical and social procedure together, we could maintain the order and moral of the people in our society
