ปัญหาการคุ้มครองภูมิปัญญาท้องถิ่นการสร้างสรรค์หน้ากากผีตาโขนด่านซ้ายศึกษาเปรียบเทียบกฎหมายไทยกับกฎหมายต่างประเทศ

Abstract

ประเทศไทยเป็นประเทศเต็มไปด้วยภูมิปัญญาท้องถิ่นที่มีความสำคัญต่อชีวิตประจำวัน การดำรงชีวิต ที่อยู่คู่กับคนในท้องถิ่นมาช้านาน ภูมิปัญญาท้องถิ่นเป็นองค์ความรู้และประสบการณ์ ต่าง ๆ ของบุคคลในท้องถิ่นที่ได้รับการถ่ายทอดต่อ ๆ กันมาจากบรรพบุรุษ หรือได้รับจากชุมชน ได้แก่ วัด ครอบครัว รวมทั้งความรู้และประสบการณ์ตรงของคนในท้องถิ่น ที่เกิดจากการสะสมประสบการณ์กิจกรรมในท้องถิ่น การประกอบอาชีพ และการเรียนรู้จากธรรมชาติแวดล้อม ซึ่งอาจจะเป็นทั้งแนวคิดกิจกรรมและบุคคลที่ได้รับการยกย่องให้เป็นภูมิปัญญาท้องถิ่น บางภูมิปัญญาท้องถิ่นก็เป็นที่รู้จักไปทั่วโลกอาจเพิ่มรายได้ให้คนในชุมชน จนถึงเพิ่มรายได้ให้ประเทศ เช่น ภูมิปัญญาหน้ากากผีตาโขนด่านซ้าย ที่เป็นภูมิปัญญาท้องถิ่นที่เชื่องโยงกับแหล่งภูมิศาสตร์ได้คืออำเภอด่านซ้าย จังหวัดเลย ด้วยประโยชน์ที่มากมายจากภูมิปัญญาท้องถิ่นการสร้างสรรค์หน้ากากผีตาโขนด่านซ้ายอาจทำให้ต่างประเทศนำภูมิปัญญาท้องถิ่นของไทยนั้นไปแสดงหาประโยชน์ และอ้างเป็นเจ้าของภูมิปัญญาท้องถิ่นนั้นหากภูมิปัญญาท้องถิ่นได้รับการคุ้มครองก็จะเป็นประโยชน์ต่อท้องถิ่นและประเทศ ประเทศไทยนั้นยังไม่มีกฎหมายเฉพาะที่ให้ความคุ้มครองกับภูมิปัญญาท้องถิ่นการสร้างสรรค์ แม้จะมีกฎหมายภูมิปัญญาท้องถิ่น เช่น กฎหมายคุ้มครองพันธุ์พืช และกฎหมายคุ้มครองและส่งเสริมภูมิปัญญาการแพทย์แผนไทย แต่ก็ไม่ได้ให้ความคุ้มครองภูมิปัญญาท้องถิ่นครอบคลุมทั้งหมด ประเทศไทยมีกฎหมายสิ่งบ่งชี้ทางภูมิศาสตร์ที่ให้ความคุ้มครองเฉพาะสินค้าหัตถกรรม และสินค้าเกษตรที่เชื่องโยงกับแห่งภูมิศาสตร์ หากกฎหมายสิ่งบ่งชี้ทางภูมิศาสตร์ของไทยนั้นมีขอบเขตการคุ้มครองถึงภูมิปัญญาท้องถิ่นการสร้างสรรค์ที่เชื่องโยงกับแหล่งภูมิศาสตร์ได้ก็จะเป็นประโยชน์ในการคุ้มครองภูมิปัญญาท้องถิ่นการสร้างสรรค์หน้ากากผีตาโขนด่านซ้ายที่เชื่องโยงกับแหล่งภูมิศาสตร์ ผู้เขียนจึงเห็นว่าหากประเทศไทยได้มีการแก้ไข ปรับปรุงกฎหมายสิ่งบ่งชี้ทางภูมิศาสตร์ให้มีขอบเขตการให้ครอบคลุมถึงภูมิปัญญาท้องถิ่นที่อิงกับแหล่งภูมิศาสตร์หรือมีกฎหมายให้ความคุ้มครองภูมิปัญญาท้องถิ่นการสร้างสรรค์โดยตรง ชุมชนหรือท้องถิ่นในประเทศไทยในหลาย ๆ ท้องที่จะได้รับประโยชน์มากเพราะภูมิปัญญาท้องถิ่นของประเทศไทยมีความหลากหลายและเป็นประโยชน์อย่างมาก หากมีกฎหมายที่ให้ความคุ้มครอง จะเป็นประโยชน์อย่างมาก

Phi Ta Khon is one of Thailand’s cultural heritage and local wisdom festivals that reflects belief, tradition, ritual, and recreational activity of the local people in Loei province. This local wisdom has been passed on from generation to generation. It incorporates the knowledge and direct experience of people in the community who have joined the local activities and learned from their surroundings. Either due to the festival itself or the people, it is regarded as the local wisdom and recognized worldwide, which can help increase the income of the community or even the country. This local wisdom has its geographical origin in Dan Sai district, Loei province. However, foreigners could take and claim ownership over it to make some benefits unless this local wisdom was protected by law. Unfortunately, Thailand has no law enforcement regarding the protection of creative local wisdom. The local wisdom protections we have include the Plant Varieties Protection Act and the Protection and Promotion of Traditional Thai Medicine Wisdom Act. Although we have the geographical indication law that protects our handicraft products, and agricultural products according to their geographical origins, it will be a significant step if Thailand could pass a law that covers the protection of our local wisdom according to the geographical origin, such as the making of Phi Ta Khon mask in Dan Sai. In my opinion, Thailand should pass a specific law to protect the local wisdom based on its geographical origin, and clearly define the term local wisdom in that regard. In addition, organizations should be established to oversee the local wisdom in different parts and communities in the country so that we can protect our own cultural heritage for the next generation.
